California Supreme Court Rules on Rest Period Intent

Los Angeles, CA – After much back and forth concerning the spirit and intent of California labor laws meaning with regards to what is a true rest period and what isn’t, the California Supreme Court has finally spoken.

Is a working break really a rest break under the California labor code?

In the past employers in certain private sector industries such as the security field have been able to count the time spent during an on call and available as needed break as a true rest period.

This wasn’t good enough for the plaintiffs of a class action suit filed by Jennifer Augustus who worked for ABM Security.  Augustus’ suit claims that ABM’s policy violated the California labor code to the tune of $90 million dollars for the class she represented.  Originally the court agreed but reversed itself on appeal by ruling that the law “prohibits only working during a rest break, not remaining available to work.”  Essentially ruling that remaining available to work is not the same as performing work.

Finally, the California Supreme Court disagreed and upheld the original order restoring the $90 million dollar award.

This ruling appears to clear the way for an industry wide flood of class action suits since it seems to be an industry standard to require guards to remain at the ready during their breaks.

Martin Luther King Day

I am happy to join with you today in what will go down in history as the greatest demonstration for freedom in the history of our nation.

 

Five score years ago, a great American, in whose symbolic shadow we stand today, signed the Emancipation Proclamation. This momentous decree came as a great beacon light of hope to millions of Negro slaves who had been seared in the flames of withering injustice. It came as a joyous daybreak to end the long night of captivity.

But one hundred years later, the Negro still is not free. One hundred years later, the life of the Negro is still sadly crippled by the manacles of segregation and the chains of discrimination. One hundred years later, the Negro lives on a lonely island of poverty in the midst of a vast ocean of material prosperity. One hundred years later, the Negro is still languished in the corners of American society and finds himself in exile in his own land. So we have come here today to dramatize an shameful condition.

In a sense we’ve come to our nation’s Capital to cash a check. When the architects of our republic wrote the magnificent words of the Constitution and the Declaration of Independence, they were signing a promissory note to which every American was to fall heir.

This note was a promise that all men, yes, black men as well as white men, would be guaranteed the unalienable rights of life, liberty, and the pursuit of happiness.

It is obvious today that America has defaulted on this promissory note insofar as her citizens of color are concerned. Instead of honoring this sacred obligation, America has given the Negro people a bad check; a check which has come back marked “insufficient funds.”

But we refuse to believe that the bank of justice is bankrupt. We refuse to believe that there are insufficient funds in the great vaults of opportunity of this nation. So we have come to cash this check- a check that will give us upon demand the riches of freedom and the security of justice.

We have also come to this hallowed spot to remind America of the fierce urgency of now. This is no time to engage in the luxury of cooling off or to take the tranquilizing drug of gradualism.

Now is the time to make real the promises of democracy. Now is the time to rise from the dark and desolate valley of segregation to the sunlit path of racial justice. Now is the time to lift our nation from the quicksands of racial injustice to the solid rock of brotherhood. Now is the time to make justice a reality for all of God’s children.

It would be fatal for the nation to overlook the urgency of the moment. This sweltering summer of the Negro’s legitimate discontent will not pass until there is an invigorating autumn of freedom and equality. Nineteen sixty-three is not an end, but a beginning. Those who hope that the Negro needed to blow off steam and will now be content will have a rude awakening if the nation returns to business as usual. There will be neither rest nor tranquility in America until the Negro is granted his citizenship rights. The whirlwinds of revolt will continue to shake the foundations of our nation until the bright day of justice emerges.

But there is something that I must say to my people who stand on the warm threshold which leads into the palace of justice. In the process of gaining our rightful place we must not be guilty of wrongful deeds. Let us not seek to satisfy our thirst for freedom by drinking from the cup of bitterness and hatred. We must forever conduct our struggle on the high plane of dignity and discipline. We must not allow our creative protest to degenerate into physical violence. Again and again we must rise to the majestic heights of meeting physical force with soul force.

The marvelous new militancy which has engulfed the Negro community must not lead us to a distrust of all white people, for many of our white brothers, as evidenced by their presence here today, have come to realize that their destiny is tied up with our destiny. And they have come to realize that their freedom is inextricably bound to our freedom. We cannot walk alone.

And as we walk, we must make the pledge that we shall march ahead. We cannot turn back. There are those who are asking the devotees of civil rights, “When will you be satisfied?”

We can never be satisfied as long as the Negro is the victim of the unspeakable horrors of police brutality.

We can never be satisfied as long as our bodies, heavy with the fatigue of travel, cannot gain lodging in the motels of the highways and the hotels of the cities.

We cannot be satisfied as long as the Negro’s basic mobility is from a smaller ghetto to a larger one.

We can never be satisfied as long as our chlidren are stripped of their selfhood and robbed of their dignity by signs stating “for whites only.”

We cannot be satisfied as long as a Negro in Mississippi cannot vote and a Negro in New York believes he has nothing for which to vote.

No, no, we are not satisfied, and we will not be satisfied until justice rolls down like waters and righteousness like a mighty stream.

I am not unmindful that some of you have come here out of great trials and tribulations. Some of you have come fresh from narrow jail cells. Some of you have come from areas where your quest for freedom left you battered by the storms of persecution and staggered by the winds of police brutality. You have been the veterans of creative suffering. Continue to work with the faith that unearned suffering is redemptive.

Go back to Mississippi, go back to Alabama, go back to South Carolina, go back to Georgia, go back to Louisiana, go back to the slums and ghettos of our northern cities, knowing that somehow this situation can and will be changed. Let us not wallow in the valley of despair.

I say to you today, my friends, so even though we face the difficulties of today and tomorrow, I still have a dream. It is a dream deeply rooted in the American dream.

I have a dream that one day this nation will rise up and live out the true meaning of its creed: “We hold these truths to be self-evident; that all men are created equal.”

I have a dream that one day on the red hills of Georgia the sons of former slaves and the sons of former slave owners will be able to sit down together at the table of brotherhood.

I have a dream that one day even the state of Mississippi, a state sweltering with the heat of injustice, sweltering with the heat of oppression, will be transformed into an oasis of freedom and justice.

I have a dream that my four little children will one day live in a nation where they will not be judged by the color of their skin but by the content of their character.

I have a dream today.

I have a dream that one day down in Alabama, with its vicious racists, with its governor having his lips dripping with the words of interposition and nullification, that one day right down in Alabama little black boys and black girls will be able to join hands with little white boys and white girls as sisters and brothers.

I have a dream today.

I have a dream that one day every valley shall be exhalted, every hill and mountain shall be made low, the rough places will be made plain, and the crooked places will be made straight, and the glory of the Lord shall be revealed, and all flesh shall see it together.

This is our hope. This is the faith that I will go back to the South with. With this faith we will be able to hew out of the mountain of despair a stone of hope. With this faith we will be able to transform the jangling discords of our nation into a beautiful symphony of brotherhood.

With this faith we will be able to work together, to pray together, to struggle together, to go to jail together, to stand up for freedom together, knowing that we will be free one day.

This will be the day when all of God’s children will be able to sing with new meaning, “My country ’tis of thee, sweet land of liberty, of thee I sing. Land where my fathers died, land of the Pilgrims’ pride, from every mountainside, let freedom ring.”

And if America is to be a great nation, this must become true. So let freedom ring from the prodigious hilltops of New Hampshire. Let freedom ring from the mighty mountains of New York. Let freedom ring from the heightening Alleghenies of Pennsylvania.

Let freedom ring from the snow-capped Rockies of Colorado. Let freedom ring from the curvaceous slopes of California. But not only that; let freedom ring from the Stone Mountain of Georgia. Let freedom ring from Lookout Mountain of Tennessee.

Let freedom ring from every hill and molehill of Mississippi. From every mountainside, let freedom ring.

And when this happens, and when we allow freedom ring, when we let it ring from every village and every hamlet, from every state and every city, we will be able to speed up that day when all of God’s children, black men and white men, Jews and gentiles, Protestants and Catholics, will be able to join hands and sing in the words of the old Negro spiritual, “Free at last! Free at last! Thank God Almighty, we are free at last!”

A Good Example of a Very Bad Guard

I stumbled across this 1:55 minute video which made me laugh and groan.

It shows a rather large and determined guard doing everything in his power to deprive someone of their skateboard.  For the life of me I can’t imagine why.

This is not how you should act when you are working as a guard.

Alleged Serial Shoplifter Arrested in Santa Ana: Police

A man suspected of robbing several stores since March of last year has been arrested in Santa Ana, police said Wednesday.

Hector Maldonado Ibarra, 29, would often take pricey women’s purses and perfumes, but also stole shirts and other apparel, from stores such as Ross and TJ Maxx, said Cpl. Anthony Bertagna.

He added that Ibarra exchanged the merchandise for narcotics.

Surveillance video captured Ibarra during several of his alleged crimes.

When confronted by security guards at stores, he allegedly brandished a weapon to get them to back off.

Investigators reached out to several retail chains and realized Ibarra was on their radar. He was allegedly hitting stores in at least seven other cities in Orange County, authorities said.

On Tuesday, officials served a search warrant at Ibarra’s home and was arrested.

At his home, which he shares with his girlfriend and three young children, investigators found heroin, methamphetamine and the stolen goods.

David Roach has put together a very well thought out and comprehensive guide for anyone considering working or already working in the field of private security today.

A thirteen year veteran of private security and a fellow USMC club member (Uncle Sam’s Misguided Children), David pulls no punches when it comes down to the brass tacks of working in this field.  This book starts off with a very welcome dose of reality in Chapter 1 entitled “You’re Not a Cop, But…” which spells out the similarities and differences between the two.  He then spends some time with the classic stereotypes that we all know and love/hate.  He even manages to throw in some informative stories from his years on the beat.

On Amazon Kindle this book received a 4.8 out of 5 stars and judging by the reviews you should enjoy it as much as I did.  All in all this is a worthy read for most and should be required reading for a lot of new and old guards.

Four Guards Honored for catching bank robber

KANSAS CITY, Mo. — The Kansas City Police Department honored four Security Officers on Tuesday for their bravery and quick thinking that netted a bank robber.

David Eubank, Greg Irwin, Neal Stack and Bryan Smock went above and beyond the call of duty when they tracked and captured suspected bank robber Stephen McRary.

Using a replica gun McRary used his ruse to threaten a tell at the Community America Credit Union when he demanded all the money in the drawer.

The Officers tracked him down and held him until the Kansas City Police Department arrived to take him into custody.

Close to $4,000 was recovered from McRary and he got a quick trip to jail with a court date before a judge, ending his criminal career.

The Officers were honored at the Kansas City Police board meeting on Tuesday.

Golden Globes 2017: A great night for Security

Among the bright glittering stars of Hollywood stand the best and the brightest in the fields of security and law enforcement.

According to the FBI, Los Angeles County Sheriff’s and the Beverly Hills Police Department, all will be working with numerous security providers which is to be expected with such a high profile event.  As expected there was a tremendous amount of security put into it.

Of course the average person watching the event at the Beverly Hilton did not see just how many pistol toting tuxedo wearers where in attendance.  For some the fashion statement of the evening was guns and garter belts.

On a positive note, everything went as planned.  Besides who won and lost, the biggest post awards event turned out to be the Tweets coming from President Elect Donald Trump over Meryl Streep’s acceptance speech.

Fort Lauderdale Shooting Suspect Faces Federal Charges in Court Monday

Esteban Santiago has already confessed to shooting up a Fort Lauderdale airport, authorities said, killing five people in the country’s latest mass shooting.

But on Monday, he will appear in federal court for the first time to face three charges. If convicted of any one of them, Santiago, 26, could be sentenced to death.

Several new developments have surfaced about the attack, the victims and how the suspect may have “slipped through the cracks.” Here’s what we know:

The suspect’s background and travels

— Santiago, a security guard living in Alaska, had served in the US Army Reserve and the Alaska Army National Guard. He completed a 10-month tour of Iraq from 2010 to 2011.

— After his time in Iraq, his aunt and brother said, he came back a changed man — hearing voices or having “visions all the time.”

— Santiago recently began selling his possessions, including his car. Friends and associates noticed more erratic behavior, investigators have learned from interviews with those who know him.

— Two months ago, Santiago voluntarily went into the Anchorage FBI office and said his mind was being controlled by US intelligence. He was “having terroristic thoughts and believed he was influenced by ISIS,” Anchorage police said.

— At that time, authorities took away his gun and ordered a mental health evaluation. But he was not deemed mentally defective, so authorities later gave him back his gun. Sources say it was the same gun Santiago used in Friday’s rampage.

— “We had this situation where he slipped through the cracks,” CNN national security and law enforcement analyst Tom Fuentes said. But Karen Loeffler, the US Attorney for the District of Alaska, said she thinks “law enforcement acted within the laws that they have.”

— Santiago told investigators he bought a one-way ticket from Anchorage to Fort Lauderdale and brought a Walther 9 millimeter pistol and two magazines.

— A lieutenant with the Anchorage airport police said Santiago had one checked bag — a handgun case containing a pistol.

— Santiago will be charged Monday with causing serious bodily injury to someone at an international airport; using a firearm during and in relation to a violent crime; and causing the death of a person through the use of a firearm.

— Though authorities do not yet know Santiago’s motive, the FBI has not ruled out terrorism.

Video of shooting released

Security footage obtained by TMZ shows the seconds before and after the shooting. The gunman walks through the baggage claim area at Fort Lauderdale-Hollywood International Airport, just steps behind a man and two boys, and pulls a handgun from his waistband.

The gunman then fires about three times before running out of the camera’s view. A couple sitting nearby drops to the ground. A woman ducks behind a baggage cart. Several people, seeing nowhere to take cover, dive face-first to the ground.

After the deadly rampage, Santiago was arrested without incident, authorities said.

The victims

Four of the five slain victims have been publicly identified; two of them were grandparents.

Terry Andres was at the airport with his wife, about to start a vacation ahead of his 63rd birthday. His wife was not wounded.

“He and Ann were married for 40 years, and he absolutely adored his children and grandchildren,” said a longtime friend who wanted to stay anonymous.

In the case of Michael Oehme’s death, there were public condolences from state Sen. Chuck Grassley of Iowa.

“Pray as I will for Oehme family of CouncilBluffs Iowa /Father Michael was killed and Kari the mother was wounded at FtLauderdale Massacre,” Grassley tweeted.

Shirley Timmons, 70, had been married for 51 years to her high school sweetheart, and “together they built a close, loving family with their three daughters, three son-in-laws and eight grandchildren,” her grandson Steve Reineccius said in a statement. “For Shirley, family meant vacations, football games and holiday traditions.”

Olga Woltering, 84, and her husband, Ralph headed to Fort Lauderdale for a cruise. Her husband was not seriously wounded.

“Olga was one of the most joyful, loving, caring and committed people I have ever met,” the Rev. Fernando Molina-Restrepo of the Catholic Church of the Transfiguration in Marietta, Georgia, said.

Two of the injured victims remained in intensive care late Sunday, while the remaining four had been released or were recovering at Broward General Hospital, Sheriff Scott Israel said.

The hospital gave slightly different numbers, saying seven victims — including five who had been shot — remained hospitalized Sunday. One gunshot victim was released Saturday, the hospital said.

Airport Shooting Suspect Used Gun Once Seized by Police: Sources

When Esteban Santiago was in an Alaska FBI office in November, saying his mind was being controlled by U.S. intelligence, he left two things in the car: a gun and his newborn child.

The Army veteran’s rambling walk-in interview at the Anchorage office was concerning enough for authorities to take away his gun and order a mental health evaluation. But it wasn’t enough to get him mentally adjudicated, which would have prohibited Santiago from owning a firearm.

Santiago got the gun back a month later when he retrieved the pistol from police headquarters, and it was that weapon, law enforcement sources told CNN, that he used to kill five people and wound six others at the Fort Lauderdale-Hollywood International Airport on Friday.

TMZ aired what appears to be airport surveillance video showing Santiago walking among passengers near baggage claim carousels when he pulls a handgun from his waistband and begins firing.

A criminal complaint filed by federal prosecutors said Santiago confessed to planning the assault.

“As far as I know, this is not somebody that would have been prohibited based on the information that (authorities in Alaska) have. I think that law enforcement acted within the laws that they have,” said U.S. Attorney Karen Loeffler, referring to Santiago having a firearm.

Santiago also had some legal trouble and was due in court again in March. But he hadn’t been convicted of a serious crime.

“He hadn’t been adjudicated a felon and he hadn’t been adjudicated mentally ill,” former FBI assistant director and CNN senior law enforcement analyst Tom Fuentes said. “So again, you know we have this situation where he slipped through the cracks.”

Here is what we know about the shooter, the victims and the facts of the case:

Santiago: I fired 15 bullets

Santiago, 26, faces three federal charges that each carry the possibility of the death penalty, the U.S. Department of Justice said Saturday.

He will be charged Monday with counts of causing serious bodily injury to someone at an international airport; using a firearm during and in relation to a violent crime; and causing the death of a person through the use of a firearm.

Santiago told investigators he bought a one-way ticket to Fort Lauderdale and brought a Walther 9-millimeter pistol and two magazines.

He said he went into a bathroom stall at the airport, loaded the gun and shot the first people he saw, according to the criminal complaint. He shot all the rounds in one magazine and then used the other, the document says.

He thinks he fired 15 bullets, aiming at his victims’ heads, the complaint says.

Investigators believe the attack plan developed over a period of time, law enforcement officials told CNN on Saturday.

Santiago recently began selling his possessions, including his car, and friends and associates noticed more erratic behavior, investigators have learned from interviews with those who know him.

Authorities are examining writings, including online posts, that in retrospect appear to indicate some period of planning, law enforcement officials said.

George Piro, the FBI’s special agent in charge in Miami, said Santiago flew from Anchorage to Minneapolis to Fort Lauderdale on a Delta Air Lines flight.

A lieutenant with the Anchorage airport police said Santiago had one bag — a handgun case with a pistol inside that he checked.

‘His mind was not right’

Esteban Santiago lived in Alaska, where he was a security guard.

In January 2016, Santiago was arrested and charged with assault and criminal mischief after an argument with his girlfriend in Anchorage, according to court documents that CNN obtained.

At the time, Santiago allegedly yelled at his girlfriend while she was in the bathroom, according to the complaint. He then broke down the bathroom door.

The woman told investigators that Santiago tried to strangle her and struck her in the side of the head, the complaint said. Santiago left before police arrived.

Anchorage municipal prosecutor Seneca Theno said Santiago pleaded no contest to criminal mischief and assault charges. Under a deferred prosecution agreement, the charges would have been dismissed if he complied with the conditions. He was due back in court on March 28.

The military said Santiago’s nine years of service in the National Guard included one 10-month tour of Iraq, where he was awarded a combat action badge.

Santiago returned from Iraq a changed man, his aunt told CNN on Saturday.

“His mind was not right,” the aunt, Maria Ruiz Rivera, said in a phone interview in Spanish from her home in New Jersey. “He seemed normal at times, but other times he seemed lost. He changed.”

She added, “He talked about all the destruction and the killing of children. He had visions all the time.”

Ruiz said she lost contact with Santiago several months ago.

“He stopped calling,” she said. “He wouldn’t respond to my messages. I would call and text. He seemed distant.”

Her family is still in shock, she said.

“Who would have imagined that he could do something like this?” she said. “I don’t say that because we’re family. I say it because he wasn’t like that.”

The suspect’s brother, Bryan Santiago, said he believes the shooting rampage resulted from mental issues that surfaced after the Iraq tour.

Esteban Santiago requested medical help from army and federal agencies, according to his brother. He received some treatment.

Bryan Santiago, in an interview in Peñuelas, Puerto Rico, said he used to speak with his brother regularly but the communication ceased about a month ago.

What was the motive?

The FBI has not ruled out terrorism, Piro said, but cautioned it was early in the investigation and authorities did not know Santiago’s motive.

Saturday, Piro said investigators “continue to look at the terrorism angle” as a possible motive.

“We have not ruled out anything,” he said. “We continue to look at all avenues, all motives.”

Piro said Santiago was cooperating with investigators, who interviewed him for several hours. The interview concluded early Saturday.

The victims

Terry Andres of Virginia Beach, Virginia, was at the airport to begin a vacation with his wife, Ann, and a celebration for the couple — his 63rd birthday was coming up, according to a close friend.

Andres died; his wife was uninjured, said the friend, who asked to remain anonymous.

“Terry was the kindest, sweetest and best kind of friend anyone could have. He was the ultimate family man,” said the friend, who has known Andres since high school. “He and Ann were married for 40 years, and he absolutely adored his children and grandchildren.”

Another victim was Olga Woltering, 84, who was traveling with her husband, Ralph. They were on their way from their home outside Atlanta for a cruise.

The great-grandmother and loyal church member died; her husband escaped serious injury, according to posts on social media.

“Olga was one of the most joyful, loving, caring and committed people I have ever met,” the Rev. Fernando Molina-Restrepo of the Catholic Church of the Transfiguration in Marietta, Georgia, told CNN. The Wolterings had been members of the church since 1978, the priest said.

Sen. Chuck Grassley of Iowa identified another slain victim as Michael Oehme of Council Bluffs. In a Twitter post, Grassley also said Oehme’s wife Kari was wounded in the shooting.

“Pray as I will for Oehme family of CouncilBluffs Iowa /Father Michael was killed and Kari the mother was wounded at FtLauderdale Massacre,” the tweet says.

Fort Lauderdale Airport Shooter ‘Came Here Specifically’ to Attack, FBI Says

The suspected gunman who opened fire at the Fort Lauderdale airport “came here specifically to carry out this horrific attack,” Miami FBI Special Agent George Piro said Saturday.

“We have not identified any triggers that would have caused this attack,” he added.

Esteban Santiago, the suspected attacker, went to baggage claim Friday afternoon to pick up his one piece of checked luggage: a case with a handgun inside, authorities said.

Santiago allegedly took the 9 mm handgun out of its case and fired at other travelers Friday afternoon, killing five people at the Fort Lauderdale airport. On Saturday, authorities revised the number of wounded to six after earlier saying eight.

A few months earlier he reportedly had a mental evaluation after a bizarre visit to an FBI office in Alaska.

The shooting sent the airport terminal into chaos, with people running for cover. They started running again when rumors of more gunshots and a possible second shooter spread through the busy airport. Almost 40 others would get hurt in the rushed evacuation after the attack. Some suffered sprains and bruises; others had broken bones.

CNN has confirmed the names of two victims. Olga Woltering, a grandmother from Marietta, Georgia, who was in Fort Lauderdale with her husband to go on a cruise; and Terry Andres of Virginia Beach, Virginia, who was on vacation with his wife to celebrate his 63rd birthday, were among five people who died when a gunman opened fire in a baggage claim area of the airport.

Who is Esteban Santiago?

Law enforcement officials identified Esteban Santiago, 26, as the suspect in the five deaths at Fort Lauderdale-Hollywood International Airport.

Santiago didn’t resist when he was taken into custody, Broward County Sheriff Scott Israel said. According to his booking information, Santiago is being held without bond on a murder charge.

He lives in Alaska, where he was a security guard. He was a member of the Alaska Army National Guard from November 2014 until August when he was discharged for unsatisfactory performance, a spokeswoman for the guard said.

In November, Santiago paid a visit to the FBI office in Anchorage, telling agents he was hearing voices and being directed by a U.S. intelligence agency to watch ISIS videos, law enforcement sources told CNN.

Piro told reporters that Santiago was turned over to local authorities and he voluntarily submitted to a mental health evaluation.

“His erratic behavior concerned FBI agents,” Piro said Saturday.

The military said Santiago’s nine years of service in the National Guard included one 10-month tour of Iraq, where he was awarded a combat action badge.

What are rules for firearms in airports/checked bags?

Taking a gun on a plane is legal if a passenger brings the weapon in a case that locks and checks the suitcase containing the gun.

The gun cannot be loaded, though regulations allow travelers who fill out a declaration form to also bring ammunition.

Florida law prohibits guns inside terminals unless they are still in their case, but there is a bill before the state Legislature to allow guns in public places such as airports.

What was it like at the airport?

Sara Graham, who had been vacationing in Fort Lauderdale, wrote on Instagram that she and her family were about 100 feet away from the shooter.

Graham said her brother led her and her mother to safety after the commotion began.

“When we first heard the shots we had no idea what was happening until everyone started running towards exits,” she wrote. “We hid for about 30 minutes and we’re let back inside, under the impression it was all safe.”

Then there was a rumor of another shooter and people started running again.

“Once we were outside, we had to run three more times until we were sure that we were safe,” she said.

They spent the rest of Friday afternoon in an aircraft hangar before people were allowed to leave.

One man told CNN’s Anderson Cooper that a laptop in a backpack he had slung over his shoulder stopped a bullet that could have killed him.

“I felt something hit my back,” Steve Frappier said, adding he thought it was luggage falling off the carousel.

It was a bullet, which ricocheted off the laptop. He found it in the side pocket of his bag.

Other witnesses described the aftermath of the shooting as a “war zone” and “mass hysteria.”

Santigo – Ft. Lauderdale Airport Shooter

Tonight there are many more questions than answers concerning the actions of Estaban Santiago-Ruiz and his murderous rampage today at the Ft. Lauderdale Airport.

We know that the 26 year old New Jersey native served in the Army Reserve and the National Guard (in Puerto Rico and Alaska).  We know that he served in Iraq from April 2010 until February 2011 and was discharged honorably four months ago for unsatisfactory performance. We know that he received a Combat Action Badge during his tour as a combat engineer.

We also know that Santiago had several run ins with local and federal law enforcement.  He was arrested and charged with domestic violence when he allegedly threatened and choked his girlfriend.

He was also being investigated for something related to child porn and that several weapons were seized along with a computer.

And finally, he had visited the FBI in Anchorage Alaska where he told agents that he was hearing voices that were telling him to join ISIS.

But he was not on anyone’s watch list.

Apparently none of this was enough to stop Santiago from buying a ticket on Delta Airlines from Anchorage to Ft. Lauderdale.  It didn’t stop him from declaring and checking a firearm and ammunition with his checked luggage in accordance with FAA and TSA regulations. It did not stop him from claiming his weapon and ammunition and using the airport bathroom to prepare for his killing spree.

Thirteen travelers shot, five dead and Santiago taken without law enforcement having to fire a shot.

So many questions.  So few answers.

Just found this channel on YouTube called Active Self Protection.  This video is narrated by John Correia and takes the viewer through a video of an armed robbery which goes wrong for the bad guy.  I was impressed.  Mr. Correia not only does a very good job narrating the video he has a ton of great points and pointers for anyone who is in the business of protecting people, places and things, especially if you are armed.

While I have not seen all of his videos I do recommend you spend some time looking them over.  So far the ones I have seen have all been worth my time.

Security Guard in fatal shooting outside Port Richmond Bar

PHILADELPHIA –

An on duty security guard killed a man during a fight outside a bar in Port Richmond.

It was around 2 am Sunday outside the Crazy Leprechaun Bar.  The 32 year old guard got into a fight with a man trying to re-enter the bar to use the bathroom.  The guard was struck in the head with a “Car Club” and stabbed in the back by several attackers.

The guard then shot his attacker in the back, who later died at Temple Hospital.

The police are looking into the matter but no charges have been filed yet and no other arrests have been reported.

ISIS Claims Responsibility for Istanbul Nightclub Attack

ISIS has claimed responsibility for the deadly New Year’s attack at an upscale Istanbul nightclub which left 39 dead.

As authorities in Turkey continue their search for the attacker, the terror group offered no further clues about the identity of the assailant. The claim — made in a statement posted to Twitter — cannot independently be verified by CNN.

“In continuation of the blessed operations which ISIS carries out against Turkey, a soldier of the brave caliphate attacked one of the most popular nightclubs while Christians were celebrating their holiday,” the statement posted to Twitter reads.

Earlier on Monday, the Kurdistan Worker’s Party, or PKK, distanced itself from the attack, which took place at the Reina nightclub during the early hours of January 1.

“No Kurdish forces have anything to do with this attack,” it said in a statement. “The Kurdish freedom fight is also the fight for democratization of Turkey. That’s why we won’t target innocent and civilian people.”

Dozens of people were hospitalized following the attack. As of Monday, 46 were still being treated, including one American, according to the Istanbul governor’s office. A handful of the injured were in critical condition.

Those killed in the attack hailed from 14 countries, including India, Morocco, Jordan, Canada, Russia, Tunisia, Saudi Arabia and Kuwait.

The suspected shooter, who stormed the nightclub soon after the clock struck midnight, appears to have evaded the tight security that blanketed Turkey’s largest city over the New Year, but authorities were confident they would apprehend him soon.

“There is strong coordination and we will find him, no delay,” Turkish Prime Minister Binali Yildirim told reporters gathered outside an Istanbul hospital, where he had been visiting people injured in the attack.

Footage of the attacker shooting a security guard and police officer at the entrance of the nightclub has emerged, lending credence to Turkish authorities’ claim that he carried out the attack alone.

A security official showed the entrance to CNN, confirming that it was the site of the video.

“We are face to face with a terror attack,” Interior Minister Suleyman Soylu told reporters Sunday morning, adding, “the efforts to locate the terrorist are ongoing. Security forces have begun the necessary operations. God willing soon (the attacker) will be apprehended.”

World leaders condemned the shooting and US officials also called it a terrorist attack, making it the first of 2017.

‘At first we thought it was a fight’

Witnesses who survived the attack explained how what should have been a celebratory evening turned into a bloodbath.

“We were having fun. At first we thought it was a fight, then there was a lot of gunfire,” eyewitness Yunus Turk told CNN.

“After the gunfire everyone started to run toward the terrace. We ran as well. There was someone next to me who was shot and fell on the floor. We ran away and hid under the sofas.”

Another eyewitness said he didn’t know how many attackers there were, but he saw one person and hid.

“I got shot in the f****** leg, man,” he told journalists as he was taken into an ambulance.

“These crazy people came in shooting everything.”

On Sunday, the club issued a statement on its Facebook page.

“This terrible incident is a terror attack against our citizens’ peace, brotherhood, serenity, economy, tourism and against our nation,” the statement read.

“Our hearts bleed and the bullets are in our heart,” it added.

A violent year

ISIS and Kurdish militants both have staged attacks in Turkey, which is still reeling from a bloody and failed military coup in July.

ISIS was suspected to be behind the attack on Ataturk Airport in June that left 44 people dead and an explosion at an August wedding, not far from the border with Syria, that killed at least 54 people.

Meanwhile, Turkish security forces clash almost daily with Kurdistan Workers Party, or PKK, militants, mostly in predominantly Kurdish parts of southeastern Turkey.

In December, a pair of bombings in Istanbul killed 44 people and wounded 155 others in an attack by a breakaway group of the PKK. The two explosions occurred after a heavily attended soccer game at Besiktas Vodafone Arena.

Also in December, a car bomb exploded near a public bus, killing 13 soldiers in the central province of Kayseri. Three days later, a gunman assassinated Russia’s ambassador to Turkey at an Ankara art gallery.
